The information that you provide on this form will be used for general attendee information, and to confirm that you understand and accept the policies of the photo sessions provided by Smita Debnath Photography. All information will be kept strictly confidential and will not be shared with any third parties.
POLICIES AND AGREEMENT
The following is the Policies and Agreement between YOU, the Client and Smita Debnath, the Photographer.
Work Product: The editing process from the session to the final product will take about 2-3 weeks.
Cancellation: The Client will respond to this agreement no later than 7 days after receiving it. If the Client doesn’t consent to the agreement, a full refund will be provided by the photographer of the booking fee. Failing to respond to this agreement will be considered as cancellation from the Client and the booking fee will not be refunded as the Photographer had to block her dates for the Client.
The full payment will have to be made at least a week before the shoot. Failing to make the payment will be considered as cancellation from the Client and the booking fee will not be refunded as the Photographer had to block her dates for the Client.
If the Client cannot attend the session on the scheduled date, the Photographer will be informed no later than 2 days from the booked date. An alternate date will be provided by the Photographer within 6 months of the initial booking date. If the proposed alternate date is not suitable to the Client then only 25% of the any payment made at that point will be refunded as the Photographer had to block her dates for the Client. Failing to inform the Photographer within the stipulated time mentioned above will be considered as cancellation from the Client and any amount paid will not be refunded as the Photographer had to block her dates for the Client.
In case of cancellation from the Photographer’s end and no alternative dates available to the Photographer, the Photographer will refund any amount paid in full.
Any extra cost that is not covered in the booking page will be paid by the Client, like travel to a particular location, extra hours etc.
Artistic Rights: The Photographer retains the right of discretion in selecting the photographic materials released to the client.
Photographic Materials: All photographic materials, including but not limited to negatives, transparencies, and previews, shall be the exclusive property of the Photographer. The Photographer shall make a gallery available through an online gallery website for the selection process. These images shall be available to the Client within 1-2 days of the session. The edited photographs will be made available through the same online gallery. If an online gallery is delivered, it shall remain open for 60 days from delivery. If the Client requests to extend the time or reopen the online gallery, a €20 fee shall apply for the gallery to be opened for another 30 days. No RAW images will be shared with the client
Copyright and Reproductions: The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright and Related Rights Act, 2000} without the written permission of the Photographer.
Client’s Usage: The Client shall only use the prints, including digital files, in accordance with the permissions within this agreement.
Indemnification: The Photographer shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.
